End User License
The following terminology applies to these Terms and Conditions, Privacy Statement and any or all Agreements: “User” refers to you, the person using the application and/or access/use/download from www.syntonetic.com and any services offered in conjunction with Syntonetic digital applications and accepting the Company’s terms and conditions. “We” refers to our Company Syntonetic. The application is a digital application that facilitates the user to automatic create playlists of users own music collection stored in users device by using a set of metadata generated by Syntontic’s back-end system and stored in the Moodagent Cloud.
In the event that you are or become a paying customer of any part of the application and/or use any of the products or services that Syntonetic offers , we will provide to you any relevant information about price, delivery procedure and cancellation options on a case by case, before completing the payment of your purchase. Any purchase will be effective upon the processing of your payment. Once you start using your application you hereby agree to wave any right to a limited time where you could revoke your purchase or claim a refund upon your cancellation of your purchase.
When your application is syncing with the Moodagent Cloud, you will send data for which your network provider will charge you at the networks regular data price.
The license in this agreement is for personal use only and only on the device you are downloading it to. The license is not transferable to another person or another device without our agreement, which will only be given in special cases.
PRIVACY STATEMENT
We are committed to protecting your privacy as well as all copyrights – no personal information nor music samples will be transmitted between users device and the Moodagent Cloud. To optimize our application we log information between the music you have and the slider positions and how they relate to songs within a playlist.
CONFIDENTIALITY
We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services such as the application.
THIRD PARTY APPLICATIONS
Syntonetic may enable you to use functionality of Third Party Applications that are not owned nor controlled by us. Content, products or services that are part of any Third Party Application that may be used in collaboration with our application are subject to the Third Party Application providers Terms and Conditions. We have no control and are not responsible or liable for any matters relating to your dealings with such third party.
COPYRIGHT
Copyright and other relevant intellectual property rights exists on all text relating to the Company’s services and the full content of our applications. We as a Company can not be held responsible for any content that is being used by the application or Moodagent Cloud that is stored on your device.
NOTIFICATION OF CHANGES
These terms and conditions are available in the App Store. Any changes to these Terms can be viewed either in iTunes App Store accessed either by computer, device or Internet.
IF ANY OF THESE TERMS ARE UNACCEPTABLE TO YOU OR IN THE EVENT THAT ANY FUTURE CHANGES TO THESE TERMS ARE UNACCEPTABLE TO YOU DO NOT DOWNLOAD OR USE THE APPLICATION. YOU AGREE TO USE THE APPLICATION OFFERED BY SYNTONETIC FOR PERSONAL USE ONLY.
